Terms of Service

By accessing or using AimFit facilities in any manner you agree to be bound by these Terms of Service. These Terms of Service set forth are the legally binding terms for your use of AimFit’s Services. You are only authorized to use AimFit Services if you agree to abide by all applicable laws and to these Terms of Service. Please read these Terms of Service carefully and request for a copy if you need. If you do not agree with them, you should discontinue use of AimFit Services immediately. If you wish to become a Member or use AimFit’s Non-Member services, you must read these Terms of Service and indicate your acceptance during the registration process.

Accounts

To access AimFit services you will need an AimFit MindBody account. You may never use another person's account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.

Member services and policies

Cancellation:

• You must cancel a class two hours in advance or the class will be deducted from your package. You may cancel class through our online system (through the AimFit website or App, whichever is applicable) or by calling the relevant studio directly.
• Master Class bookings must be cancelled 24 hours prior to the class.
• In case you face an injury or a medical condition, you must inform your branch  representatives by emailing the branch directly. For all valid requests, the monetary value of the remaining classes will be added to the client’s AIMFIT account and can be used by the client for a purchase later. If you are unable to visit a doctor due to the COVID-19  outbreak, you can present proof of an online/teleconsultation with a doctor/physiotherapist.
• For any reason other than medical, refunds will not be processed.
• No Cash refunds are made in any case.

Reservation:

You must be physically present five minutes before the reserved class or your spot may be given to a waitlisted client.

Class Attire and Shoes

You must be dressed in proper workout clothes and workout shoes to ensure entry into the class. Failure to wear safe and appropriate attire will mean denied entry into class.

Personal Belongings

You agree that AimFit is in no way responsible for the safekeeping of your personal belongings while you are present in the studio. You assume all risk of loss for any of your personal belongings.

Code of Conduct

While inside AimFit premises (whether you are using AimFit Services or not) you agree to abide by the AimFit Code of Conduct. Any rude, threatening, verbally or physically abusive behaviour towards any persons (client or staff or any other) while you are within AimFit premises violates this code of conduct. Upon violation, AimFit reserves the right to terminate your membership without refund, adjustment or liability

All rules and regulations

• All classes, challenges, class-pass packages and other services are for a fixed duration and fixed number of classes as mentioned on the price list. They cannot be extended beyond the date of expiry or frozen under any condition. There will be no exceptions.  
• All classes, challenges, monthly class-pass packages and other services are non-transferable and non-refundable. There will be no exceptions.  
• You must be dressed in appropriate workout clothes and workout shoes to ensure entry into the class.
• You must leave all equipment at the end of the class for the team to sanitize it properly before the next class.
• Equipment and class spots are first come, first serve and cannot be saved.
• Booked master class must be changed or canceled 24 hours prior to the class.
• Students may not vary from instructed exercises.
• All injuries must be reported to the instructor before each class.
• You should arrive at least 10 minutes prior to class. If you are not physically present and have not signed in within five minutes before the start of your scheduled class, your spot may be released to an individual on the waitlist.
• In case of COVID lockdown imposed by the government, all clients with active challenges will shift to AIMFIT Home Workout Challenge, the remaining amount will be transferred to the clients AIMFIT Account.
• In case of a family member contracting COVID, the client will be shifted to AIMFIT Home Workout Challenge while the remaining amount stays in their AIMFIT Account.
• In case of a client contracting COVID, the client’s amount of active challenge will be transferred to their AIMFIT account.
• Medical Prescription and Covid report is mandatory to exercise these policies.
• COVID Vaccination is mandatory to take any classes at any AIMFIT location. Proof of vaccination must be shown before purchasing any challenge.
• Your vaccination proof along with your CNIC number will be saved in AIMFIT’s record for all future updates of vaccination. Falsifying your evidence  of vaccination may result in immediate termination of your classes at AIMFIT.  
• AIMFIT studios have cameras installed for security reasons only. Access of the footage is only with restricted staff at the company and can only be accessed in case of emergency or a need basis.
• AimFit clients are strictly not allowed to film AimFit classes even if the focus of the coverage is on them
• If a client wants to film or take a photograph in the class, they must approach the instructor and the instructor must make an announcement on their behalf in the class. We understand some clients who join us are interested in taking photos/pictures for their social media. This is also great community content for AimFit, however, it must only be allowed once the instructor has announced in class and anyone who is not comfortable has been informed to move out of the photo/frame.
• If a client is found to film or take pictures in an AimFit class without consent from the instructor and other fellow clients they will be asked to delete all footage from their phone and ensure the AimFit staff has checked and is thoroughly satisfied. The client will also be issued the first and final warning - their membership will be cancelled if they are found to do so again.
• If a client is found to film or take pictures in an AimFit class more than once (and has received a warning before) their membership will be cancelled and they will not be allowed at AimFit premises anymore.
• Any clients who lose their membership due to breach of policy or AimFit's code of conduct will not be liable to a refund and will not be allowed to make a future purchase at AimFit
• AimFit will engage in legal proceedings against any clients who film or take pictures within AimFit studios without AimFit's consent and share these publicly or privately.

Limitation of Liability

By signing this document and/or attending classes, events, activities, and other programs and using AimFit studio facilities and equipment, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in the strenuous nature of AimFit’s workout programs. You acknowledge that you have voluntarily chosen to participate in a program of intense physical exercise. You acknowledge that AimFit strongly recommends that you consult with your physician prior to commencing any class. You also acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries. You further acknowledge that the specific risks vary from one activity to another, but range from (1) minor injuries such as scratches, bruises, and sprains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions; and (3) catastrophic injuries including paralysis and death. At all times, you shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to you by trainers and staff. In consideration of being allowed to participate in and access AimFit classes and studio facilities, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to AimFit classes and studio facilities, (2) release, indemnify, and hold harmless AimFit, subsidiary affiliate entities and franchisees, and each of their respective members, employees and representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in AimFit classes or AimFit  studio facilities, and (3) represent that you (a) have no medical or physical condition that would prevent you from properly using any of AimFit classes and studio facilities, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise. You acknowledge that if you have any chronic disabilities or conditions, you are at risk in participating in AimFit classes and use of studio facilities, and should not be participating in any classes.

Termination

We may terminate your access to our site and facilities without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability

Governing Law

This Agreement (and any further rules, policies, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of the Government of Pakistan, without giving effect to any principles of conflicts of law.

Changes to this agreement

We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on our website and physical locations. Your continued use of our facilities after any such changes constitutes your acceptance of the new Terms of Service. We encourage you to review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access AimFit facilities or discontinue any use of them immediately.

Eligibility

Membership is void where prohibited. AimFit facilities are intended solely for users who are 16 years of age or older. Minors between the ages of 10 and 16 may register only with the supervision of a parent or guardian for DanceFit, YogaFlow, BodyBlast and ComboFit classes only.

Fees

You acknowledge that AimFit charges fees for its services, and AimFit reserves the right to change its fees from time to time at its discretion. If AimFit terminates your membership because you have breached these Terms of Service, you may not be entitled to a refund of any unused portion of membership or other fees.
